Terms + Conditions

Thanks so much for taking time to read these important Terms and Conditions. These points are highlighted for emphasis, and complete Terms and Conditions are found below.

By working with Videre Travel and signing these terms, clients are accepting these terms & conditions and authorize Travel Marketing Link Corp. dba Videre Travel to use the credit card provided herein to make payments on behalf. Client understand that credits, refunds, and cancellations are at the discretion of the supplier(s) and not Travel Marketing Link Corp.  Client understands that Travel Marketing Link Corp is not the source or supplier of the travel services requested, and acts solely as an agent for the actual suppliers of such services. Client has been advised that the suppliers whose names appear in the information supplied are those who are actually responsible for providing the travel services purchased. Travel Marketing Link Corp's exposure is limited to the amount of commission paid and the company is not responsible for the actions or inactions of suppliers, including if third-party travel supplier financially defaults. Client consents to and requests the use of those suppliers and agree not to hold Travel Marketing Link Corp. responsible should any of these suppliers: 1) fail to provide the travel services I have purchased; 2) fail to comply with any applicable law; or 3) engage in any negligent act or omission that causes me any sort of injury, damage, delay or inconvenience.

​1. QUOTED PRICING: Quote/option pricing is not guaranteed until Videre Travel receives payment or credit card guarantee. If we do not receive final payment by the specified date, we reserve the right to cancel the reservation. In the case of billing errors, we reserve the right to re-invoice with correct pricing. It is not possible to provide detailed cost breakdowns for complete itineraries.

2. DEPOSITS AND FINAL PAYMENT: To secure your booking, Videre Travel requires the Client to pay a non-refundable deposit at the time of confirmation of the trip or journey.  The deposit is typically 30% of the final price, though in some cases the percent due to confirm a trip can be 50% up to payment in full if the date of travel is within 60 days. All deposits are non-refundable. The remaining balance is due no later than sixty (60) days prior to the start date for the trip or journey and payment in full becomes non-refundable at the time of payment.  Failure to remit final payment by the deadline may result in the cancellation of your trip or journey and the Client will forfeit the entire deposit. In addition, no tickets or documents for trips requiring travel will be released to the Client until final payment is received. â€‹

3. TRAVEL INSURANCE and CANCELLATIONS: We suggest in the strongest way possible that all travelers purchase travel insurance for each and every trip. While you may feel some circumstances warrant leniency on cancellation penalties, it is not for Videre Travel to make this decision. We always recommend travel insurance for this reason, read our complete statement on Travel Insurance here. All cancellations must be advised in writing. At the time of booking you will be advised of the cancellation policy of your hotel and/or program. If a cancellation policy has not been provided to you, you are to assume the booking is non-refundable. Cancellation policies vary and are implemented by the supplier. â€‹â€‹

 

4. PASSPORTS +VISAS:

​A valid passport is required for all international travelers. Your passport must be valid at least six months after your date of return to the U.S. The name on your reservation must match the name on your passport. Non-U.S. citizens must consult with the appropriate consulates to determine if any additional visas are needed. It is suggested that all passengers, regardless of the passport they hold, check with the appropriate consulates of the countries being visited to determine if any visas are needed. Currently the following popular countries to visit require visas for United States citizens that in some cases MUST be organized in advance and is the sole responsibility of the traveler. Videre Travel can not process Visas on your behalf, though we can assist when possible. Failure to secure a Visa if needed means you will be denied boarding on your outbound international flight (please note, there are additional countries that require visas that are not included in this list):

5. COVID-19: An inherent risk of exposure to COVID-19 exists in any public place where people are present. COVID-19 is an extremely contagious disease that can lead to severe illness and death. By traveling, you voluntarily assume all risks to exposure to COVID-10. Furthermore, as countries begin to reopen and react to the very fluid pandemic situation, destinations may impose restrictions and requirements that could impact the course, cost and timing of your trip.

These are the detailed Terms and Conditions that will apply to your trip with Travel Marketing Link Corp dba Videre Travel (hereinafter collectively referred to as “Videre Travel” or “We”) as well as the use of our website www.videretravel.com  (the “Site"). 

 

PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY, AS YOU AND YOUR TRIP COMPANIONS WILL BE BOUND BY THEM.

These Terms shall constitute the entire agreement between Videre Travel, a Colorado corporation and You, the Client, relating to the subject matter herein, and shall constitute a binding agreement. There is no verbal or written representation, warranty, prior agreement, or description of services, other than as expressed herein.

 

The contract and registration is made with, and services will be provided by, Videre Travel. By registering for a trip or a journey and making deposit payment or holding services via credit card guarantee, you agree to be bound by these Terms and Conditions that govern Your relationship with Videre Travel. These Terms and Conditions affect your rights and designate the governing law and forum for the resolution of any and all disputes.

Client understands that the Transportation Security Administration (TSA) requires me to carry a government-issued identification card in order to board a flight. Client has been advised that the name, date of birth and gender that appears on the identification card must exactly match the same such data that is listed on airline ticket and in booking records. Client acknowledges that failure to strictly comply with these requirements may result in denied boarding or an undue delay at an airport security checkpoint causing client to miss flight.  Client further acknowledges that beginning on October 1, 2020, travelers must present a driver’s license or another form of identification that complies with the requirements of the Federal Real ID Act (see www.dhs.gov/real-id for more information). Client understands that if traveling internationally, client must have a valid passport and, depending upon my destination and nationality, may need to obtain one or more visas. Note to Client: Passport and visa information may be obtained by contacting the Travel Agent Section of the U.S. State Department at 202.647.5225 or by visiting the State Department's Web site at travel.state.gov. Non-U.S. passport holders should be sure to contact the embassies of their destination and transit countries to obtain entrance requirements. To obtain medical information, you may contact the Centers for Disease Control at 404.332.4559 or visit the CDC's Web site at www.cdc.gov

Client understands that the airline tickets, air tours or other products purchasing are subject to supplemental price increases that may be imposed after the date of purchase. Post-purchase price increases may be applied due to additional costs imposed by a supplier or government. Client acknowledges there may be additional sums charged by Travel Marketing Link Corp. to offset increased fees, fuel surcharges, taxes, fluctuations in foreign exchange markets or any combination thereof. Client hereby consents to any post-purchase price increases and authorize Travel Marketing Link Corp to charge credit card for such additional amounts. Client also understands that quote/option pricing is not guaranteed until Travel Marketing Link Corp receives payment or credit card.  

 

BOOKING A TRIP OR JOURNEY

​

All persons wishing to book a trip or journey have carefully read and understand the Terms and Conditions that follow. By taking the step to engage with Videre Travel, you accept on behalf of yourself and all those named on the registration, including minor(s) and/or person(s) under a disability (collectively referred to as the “Client”) to be bound by these Terms and Conditions. Bookings are accepted and becomes definite only from the date when Videre Travel sends a confirmation email. It is at this point that a contract between Videre Travel and the Client comes into existence. Before your registration is confirmed and a contract comes into force, Videre Travel reserves the right to increase or decrease trip prices. Videre Travel reserves the right to decline any booking at their discretion. 

 

VIDERE TRAVEL’S RESPONSIBILITY

​

Videre Travel acts as an agent for the airlines, tour operators, cruise lines, lodging providers, car-rental companies, ground operators, destination partners, and any other suppliers of travel services (collectively “Suppliers”) shown on your itinerary. We are not responsible for the acts or omissions of such Suppliers, in destination partners (or their contractors and subcontractors) or their failure to provide services, adhere to their own schedules, or honor their contracts.

 

Videre Travel is not responsible if vendor, in-destination partner or other Suppliers go out of business prior to your trip.  As such, you acknowledge and understand that cruise lines, tour operators, and other Suppliers have their own contracts covering cancellation penalties and other terms and conditions, and that you may be bound by those contracts regardless of whether you receive notice of their terms. Videre Travel encourages you to refrain from purchasing non-refundable travel and/or travel insurance until you receive an email confirmation from Videre Travel staff. All tour operators, cruise lines, and some resort hotels impose cancellation and change penalties, too. Please view the applicable rules before you make your reservation.

Quote/option pricing is not guaranteed until Videre Travel receives payment or credit card guarantee. Certain products may have additional deposit requirements. Deposits may be refundable, partially refundable, or non-refundable, your Travel Advisor will notify you of the policy at the time of the quotation or on your balance due invoice. The deposit is applied to your final payment, which is typically due at least 60 days prior to departure. If we do not receive final payment by the specified date, we reserve the right to cancel the reservation. In the case of billing errors, we reserve the right to re-invoice with correct pricing.

All cancellations must be advised in writing. At the time of booking your Travel Advisor will advise you of the cancellation policy of your hotel and/or program. If a cancellation policy has not been provided to you, you are to assume the booking is non-refundable. Cancellation policies vary and are implemented by the supplier. Please verify with your Travel Advisor if you have any questions on the cancellation policy. While you may feel some circumstances warrant leniency on cancellation penalties, it is not for Videre Travel to make this decision. DEPOSITS AND FINAL PAYMENT

FEE SCHEDULE

​

Videre Travel charges non-refundable fees for some specific travel planning services including:

​

- $50 ticketing fee per person for all flights (per person airline ticket)

- 3% for all credit card transactions

- Cancellation fees:

  • $25 per hotel cancellation

  • $100 per person, cancellation fee for a custom trip that has been deposited but not

    paid in full

  • $200 per person, cancellation fee for a custom trip that has been paid in full

  • $50 per person, cancellation or change fee for flights (per person airline ticket)

Requests for minor revisions to your program are encouraged and welcomed. We will make every effort to make the necessary revisions to your program for as long as needed. We will accept 1 major revision request per program. A major revision is a complete change in destination, itinerary, or significant date change after trip planning has begun. Additional revisions may be subject to special handling fees.

​

The company reserves the right to waive or adjust these fees at any time.

Air Travel 

​

As a courtesy to our clients, Videre Travel can book air travel if requested. However, in the event of a global pandemic or other event in which travelers prefer to cancel and flights are non-refundable (as is customary), Videre Travel will not be held liable for the airlines ultimate decision to refund a flight or not. Videre Travel will not be held liable if the credit card company confirms a dispute. In the event of a successful credit card dispute, Videre Travel will invoice the client for the disputed amount. Please remember that we only offer flight bookings as an additional service that supports your travel program. 

​

Pandemics and Government Actions

​

In the extreme case of a pandemic or government action that cancels, delays, or interrupts your travel, Videre Travel will act in compliance with all government regulations and will act according to supplier imposed policy. We are not liable for any losses incurred during these situations, such as in the case of a refund not being issued by a supplier during extraordinary, unforeseen circumstances. However, we will advocate for the traveler to the best of our ability and within reason before required to charge a minimum of $100 service cancellation fee to the traveler. Please note, traditional travel insurance policies do not cover pandemics or government actions, you must purchase a “Cancel for Any Reason” add on to be covered for these extreme events.

 

ERRORS BY VIDERE TRAVEL OR THE CLIENT

​

Videre Travel provides a variety of trips and journeys for its clients, each with their own unique itineraries.  Please refer to your specific itinerary for details regarding your trip or journey.  Following confirmation of your trip or journey, You will receive a confirmation document detailing the specifics of your trip (i.e., destination, activities requested, names and ages of all participants, accommodations, etc.).  Clients must notify Videre Travel of any mistakes in the bookings or itineraries within 24 hours of receipt of the documents.  IF VIDERE TRAVEL IS NOT NOTIFIED OF ANY ERRORS WITHIN THE 24-HOUR TIME PERIOD, VIDERE TRAVEL DISCLAIMS ANY LIABILITY ASSOCIATED WITH THE ERROR(S).  

 

OMISSION OR OVERSIGHT BY CLIENT

​

Videre Travel disclaims any and all liability for omissions of essential information by the Client.  Such omissions may include, but are not limited to, the number of participants, important health or dietary information, skill or fitness level, or the age of all participants.  Similarly, Videre Travel disclaims any and all liability associated with any oversight of essential information or items that are identified as the Client’s responsibility to obtain in the documents provided to the Client by Videre Travel.  Such oversights may include, but are not limited to, the Client’s failure to obtain the necessary visas, if required, or the failure to bring a valid form of identification such as a passport for travel. 

 

MEDICAL CONDITIONS & SPECIAL REQUIREMENTS

​

The Client must notify Videre Travel in writing during the process of booking (on your registration form) of any medical conditions, pregnancy, disability or any other mental and or physical condition which may affect fitness to travel and engage in the requested activity and/or any medical condition. Failure to notify Videre Travel may result in the Client being refused travel. Failure to notify Videre Travel of any such condition that results in cancellation will result in the assessment of full cancellation fees to the Client. Some trips may be unsuitable for Clients due to age, mobility, disability, pregnancy or physical or mental conditions. It is the Client’s responsibility to check prior to registering. Videre Travel may refuse to carry pregnant women over 24 weeks or Clients with certain conditions. Videre Travel is not required to provide any special facilities unless it has agreed to do so in writing. Videre Travel will do its best to meet the Client’s special requests, including dietary requests, but such requests do not form part of the Contract and therefore Videre Travel is not liable for not providing these requests. Medical facilities vary from country to country and Videre Travel makes no representations and gives no warranties in relation to the standard of such treatment.

 

ACCEPTANCE OF BOOKING & FINAL PAYMENTS

Videre Travel will confirm acceptance of the Client’s booking via email. Please ensure Videre Travel is on your contact list so our emails don’t go to your junk folder!

​

If you are traveling to a foreign country, Videre Travel is not responsible for any fees incurred due to currency exchange or fees charged by your credit card/bank for processing funds in another currency. Currency rates quoted on this website are based on various publicly available sources. Rates are not verified as accurate, and actual rates may vary.

 

FINAL PAYMENT 

​

As discussed above for all programs, the payment of the final balance payment is due sixty (60) days prior to the program start date. If the final balance is not received by the due date, then your booking cannot be guaranteed and Videre Travel reserves the right to cancel your booking and forfeit your deposit. Final payment becomes non-refundable at the time of payment.

 

Videre Travel accepts payment by check or by most major credit cards.  If payment is made by credit card, the Client is responsible for payment of the processing fee charged by the credit card company (typically 3%).  There is no processing fee if payment is made by check, but the Client recognizes and acknowledges that they are waiving certain protections typically afforded to credit card purchasers.

TRAVEL & HEALTH INSURANCE

​

Videre Travel highly recommends Clients obtain travel and medical insurance with a minimum medical coverage of $100,000 while traveling with Videre Travel. This insurance must cover personal injury and emergency medical expenses including, but not limited to, helicopter evacuation, air, ambulance, and repatriation.  As discussed below, such costs will be borne solely by the Client, which can become quite substantial.

It is strongly recommended the coverage be extended to include cancellation, curtailment, and all other expenses that might arise as a result of loss, damage, injury, delay or inconvenience occurring to the Client during travel. Videre Travel shall have no liability for loss, theft of or damage to baggage or personal effects. Personal belongings lost or stolen while unattended by the client in public lounges or other public areas, whether on board a train, bus, or other mode of transportation, publicly owned or operated by Videre Travel or elsewhere, are not reimbursable. Losses due to ordinary wear and tear, and other acts of God are not reimbursable. Videre Travel cannot accept responsibility for and in no event shall be liable for loss or damage of valuables or other articles left in or on facilities used by Videre Travel such as hotels, rental properties, expedition vehicles, or any other mode of transportation. The Client acknowledges that the cost of Videre Travel’s trips and journeys do not include insurance and that the Client has been advised to obtain separate coverage at an additional cost. When obtaining travel insurance the Client must ensure the insurer is aware of the type of travel to be undertaken.​

 

If clients have a future travel credit with a supplier, and hold 3rd party insurance, clients may not be protected from supplier default until a future date of travel is confirmed. Furthermore, suppliers cannot sell insurance to protect against their own bankruptcy, so if client has taken a future travel credit and has insurance that is provided by the supplier, we advise to consider purchasing an additional 3rd party insurance policy to protect against bankruptcy.

 

We also strongly recommend that you use a credit card for your purchase, so that you can exercise your rights under the Fair Credit Billing Act if you do not receive the services you purchased.

 

FLIGHT TIMES, CONNECTION TIMES, AND BAGGAGE ALLOWANCE

​

All flight times, carriers, equipment and itineraries are subject to change with or without prior notice. If Videre Travel is made aware of a change by a travel service provider, it will use commercially reasonable efforts to advise the Client as soon as possible. For air travel, please contact the applicable airline 24 hours prior to departure to reconfirm flight times and status. In the event of a flight delay related to weather, traffic or another force majeure situation, it may not be possible for the air carrier to provide meals and/or accommodations. Videre Travel is not responsible for lost wages, missed vacation time or any other additional charges incurred as a result of changes in times or itineraries. It is the Client’s responsibility to arrive timely to check-in and make their flight. Videre Travel is not responsible if the Client misses their flight. 

 

The Client should allow for the minimum connecting time approved by the applicable travel service provider in order to reduce the risk of missing connecting flights. All connecting flight reservations are made at the risk of the Client and Videre Travel is not liable for damages or additional fees incurred by the Client owing to a missed flight connection, whatever the reason. 

 

The Client must consult the terms and conditions of the applicable airline for restrictions on the number and weight of baggage on chartered and scheduled service. Lost or damaged baggage is the responsibility of the airline, which may have limited liability. Videre Travel recommends the purchase of insurance for loss of, or damage to, baggage. In the event of damaged, lost or delayed baggage, please contact the applicable airline representative prior to leaving the airport. Failure to do so will invalidate the Client's claim.

 

EVACUATION PROCEDURES AND COSTS

​

Any Evacuations costs are to be covered by the person being evacuated, hence the recommendations regarding travel insurance above.  Videre Travel expressly disclaims any liability for costs associated with the evacuation or rescue of any Client.

 

TRAVEL DOCUMENTS

​

The Client must be in possession of a valid passport or other acceptable form of identification required for entry, departure and travel to destinations (passport must be valid 6 months past the return date), all visas, permits and certificates, including vaccination certificates (if required), insurance policies, etc. are required for the whole of the journey. The Client accepts full responsibility for obtaining all such documents, visas, and permits prior to the start of the trip or journey and is solely responsible for any adverse consequences resulting from missing or defective documentation. Any information or advice given by Videre Travel regarding visas, vaccinations, climate, clothing, baggage, special equipment, etc. is purely advisory, provided as a courtesy to the Client, and Videre Travel is not responsible for any errors or omissions as to the information provided by third parties such as the appropriate governmental authorities.

 

CLAIMS & COMPLAINTS

​

If a Client has a complaint against Videre Travel, the Client must first inform Videre Travel at the earliest opportunity to allow the grievance to be rectified, if possible. Failure to indicate dissatisfaction whilst on a trip will result in the Client’s ability to claim compensation from Videre Travel being extinguished or at least reduced. If satisfaction is still not reached through these means on a trip then any further complaint must be put in writing to Videre Travel within 10 days of the end of the trip. Videre Travel will work with its Suppliers try to reach a satisfactory resolutions for the Client, but Videre Travel does not guarantee any particular outcome, refund, or resolution. Videre Travel and the Client will abide by the terms and conditions, contracts, and penalties of a Supplier, vendor, or in-destination partner. 

 

CLIENT RESPONSIBILITY

​

The Client acknowledges he or she will be visiting places where geographical attributes present certain risks, dangers and physical challenges greater than those present in their daily life. By booking travel with Videre Travel, the Client acknowledges they have considered the potential risks, dangers and challenges, and expressly assumes the risks attendant to such travel conditions. The Client is solely responsible for acquainting themselves with weather conditions, physical challenges, and laws in effect at each stop along the itinerary.

 

SUPPLIERS & INDEPENDENT CONTRACTORS

​

Hotels, excursions, or other elements of a Videre Travel trip or journey will be arranged by Videre Travel with local Suppliers who may themselves engage the services of local operators and/or sub-contractors. Videre Travel will at all times endeavor to appoint reputable and competent local Suppliers. The terms and conditions of the Suppliers will be applicable. These may limit or exclude the liability of the Supplier. Videre Travel is not liable for Suppliers or their independent contractors actions or inactions.

 

USE OF PROVIDERS OUTSIDE OF VIDERE TRAVEL’S NETWORK

​

While Videre Travel vets each and every one of its providers, the Client is still allowed to hire their own provider (i.e., guide) if they so desire.  That said, Videre Travel makes no representations regarding the Client’s choice of provider(s) and disclaims all liability for any actions or inactions by the provider(s) hired by the Client.

 

SAFETY & TRIP ENJOYMENT

​

We take your safety and well-being very seriously. However, you are ultimately responsible for your safety, which is why you may be asked to sign a liability waiver before departure. To avoid possibly dangerous situations, it is extremely important that you obey any rules and regulations imposed by Videre Travel, the providers on your trip or journey, and instructions given by them. Videre Travel reserves the right to prohibit any Client from continuing on a trip with no right of refund if, in our opinion, that Client’s actions pose a threat to the safety of them, others, or to the wildlife, or if that Client’s actions or behaviors are seriously jeopardizing the enjoyment of the trip for others. The decision of Videre Travel or the provider(s) will at all times be final on all matters likely to affect the safety and well-being of the trip. All Clients must, at all times, strictly comply with the laws, customs, foreign exchange and drug regulations of all countries visited, and Videre Travel will not accept responsibility or liability for any Client who contravenes any laws or other regulations of any country or state visited.

 

HEALTH & FITNESS

​

Most Videre Travel trips should not be overly strenuous for people who are healthy and reasonably fit. If you (or anyone on whose behalf you are registering) are affected by any condition, medical or otherwise, that might affect your or other people’s enjoyment of the trip, you must advise us of this at the time of booking. If your health or fitness changes between the time of booking and the trip departure date, you must notify Videre Travel of these changes before the trip starts.

 

PHOTOGRAPHY

​

In the course of participation in a Videre Travel trip or journey, photos or video may be taken by participants or providers. These images may be used in any Videre Travel materials, website, Facebook, etc., unless Clients specifically request to the photographer or in writing to Videre Travel, to not use any material your image is depicted in.  Otherwise, permission is granted to Videre Travel to perpetual, royalty-free, worldwide, irrevocable license to use such images for publicity and promotional purposes.

 

ITINERARY CHANGES

​

Videre Travel and its Suppliers reserves the right to alter trip or journey and itineraries for any reason.  Trips or itineraries may be changed or cancelled at any moment due the trip to assure the safety of our clients and staff. No responsibility is accepted for losses, expenses due to delays, changes of flights, missed flight connections, or other services because of strikes, accidents, sickness, damage, negligence, weather, war, changes in schedules or other similar causes. Videre Travel and its partners do not assume responsibility for accidents or deaths that can be traced to the participants’ negligence, acts of third parties or exterior circumstances such as weather, natural occurrences, ware or other similar causes.

 

DATA PROTECTION

To ensure that trips and journeys run smoothly, Videre Travel needs to use personal information (such as name, address, special needs, health conditions, dietary requirements etc.) provided by Clients to Videre Travel, and also pass on such information to the providers involved in the operation of the trip. Videre Travel will apply appropriate security measures to protect such personal data and will only pass on data that is applicable to hotels or suppliers responsible for the tour. By completing the Videre Travel Retreat Registration Form, Clients consent to this information being transferred as required.

 

LIMITATION OF LIABILITY

UNLESS INJURY OR DAMAGE WAS DIRECTLY CAUSED BY THE GROSS NEGLIGENCE OR WILLFUL MISCONDUCT OF VIDERE TRAVEL, CLIENT SHALL DEFEND, INDEMNIFY AND HOLD HARMLESS VIDERE TRAVEL AND ITS AFFILIATES, AND EACH OF THEIR RESPECTIVE SHAREHOLDERS, DIRECTORS, MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, AGENTS AND REPRESENTATIVES, AND EACH OF THE HEIRS, EXECUTORS, SUCCESSORS AND ASSIGNS OF ANY OF THE FOREGOING AT CLIENT’S SOLE COST AND EXPENSE AGAINST ALL SUITS, JUDGMENTS, LOSSES, PAYMENTS, COSTS, EXPENSES (INCLUDING, WITHOUT LIMITATION, REASONABLE ATTORNEYS’ FEES), DAMAGES OR CLAIMS FOR DAMAGES, SETTLEMENTS, LIABILITIES, FINES AND PENALTIES OF THE INDEMNIFIED PARTIES ARISING FROM OR IN CONNECTION WITH CLIENT’S TRIP OR JOURNEY, INCLUDING, WITHOUT LIMITATION, ANY CLAIM OR LIABILITY FOR ANY DEATH, BODILY INJURY OR PROPERTY DAMAGE WHICH IS MADE, INCURRED OR SUSTAINED BY CLIENT OR ANY CLIENT INVITEES. THIS INDEMNIFICATION SHALL ALSO APPLY TO ANY RENTAL EQUIPMENT ORDERED THROUGH VIDERE TRAVEL FOR CLIENT USE OR USE OF ANY RECREATIONAL ACTIVITIES (INCLUDING ANY USE OF POOLS, WATER FEATURES, HOT TUBS, AND OTHER BODIES OF WATER) USED BY CLIENT. VIDERE TRAVEL SHALL IN NO EVENT BE LIABLE FOR SPECIAL, CONSEQUENTIAL, INDIRECT OR INCIDENTAL DAMAGES ARISING FROM OR IN CONNECTION WITH CLIENT’S PROGRAM, OR ARISING FROM THE BREACH OF THIS AGREEMENT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

 

ACCEPTANCE OF RISK

The Client acknowledges that the nature of the trips and journeys offered by Videre Travel are adventurous in nature and may involve a significant amount of personal risk for the Client.  The Client hereby assumes all such risk and does hereby release Videre Travel from all claims and causes of action arising from any damages or injuries or death resulting from these inherent risks. At the time of payment, the Client is required to sign Videre Travel’s RELEASE OF LIABILITY, WAIVER OF CLAIMS, ASSUMPTION OF RISKS AND INDEMNITY AGREEMENT. Please read carefully.

 

SEVERABILITY

​

In the event that any term or condition contained herein is unenforceable or void by operation of law or as being against public policy or for any other reason than such term or condition shall be deemed to be severed from this Agreement or amended accordingly only to such extent necessary to allow all remaining Terms and Conditions to survive and continue as binding.

 

SUCCESSORS AND ASSIGNS

These Terms and Conditions shall inure to the benefit of and be binding upon Videre Travel and the Client and their respective heirs, legal personal representatives, successors and assigns.

The Company, Videre Travel exists under, and is pursuant to, the laws of the State of Colorado, U.S.A.

 

APPLICABLE LAW

​

The Contract and these Terms and Conditions are subject to the laws of  the State of Colorado.

 

DISPUTE RESOLUTION/AGREEMENT TO ARBITRATE

​

In the event a dispute of any kind arises out of, in connection with, or relating to these Terms of Service between you and the Videre Travel (including any dispute concerning its construction, performance or breach), the parties agree to submit the dispute to arbitration for final resolution.  You and Videre Travel agree to attempt to resolve the dispute informally for at least 30 days before proceeding to arbitration. All documents, discovery and other information related to any such dispute, and the attempts to resolve or arbitrate such dispute, will be kept confidential to the fullest extent possible. If a dispute arises, any party to the dispute will give written Notice to each other party. After Notice has been given, the parties in good faith will attempt to negotiate a resolution of the dispute. If, within 45 days after the Notice has been given, a dispute is not resolved through negotiation or mediation, the dispute will be arbitrated and submitted to JAMS/Endispute, and in accordance with the commercial arbitration rules of JAMS/Endispute.  Any such controversy or claim will be arbitrated on an individual basis, and will not be consolidated in any arbitration with any claim or controversy of any other party.  The arbitration will be conducted using the JAMS/Endispute service, and judgment on the arbitration award may be entered into any court having jurisdiction thereof. The parties agree to share the cost of Arbitration. The parties further expressly agree that if a dispute arises regarding the applicability of arbitration under this clause, then the issue of whether this dispute is subject to arbitration will also be decided by arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association and not by a court of law.  The prevailing party shall be entitled to recover reasonable attorneys’ fees and costs in the arbitration. Judgment upon any award rendered by the arbitrator may be entered in any court having jurisdiction thereof.  The prevailing party shall be entitled to recovery of reasonable attorneys’ fees in any court proceeding relating to this agreement to arbitrate or the enforcement or collection of any award or judgment rendered under this Agreement. 

 

WAIVER OF TERMS & CONDITIONS

These Booking Terms and Conditions may only be waived or amended by written mutual consent. When a Client completes and submits the Registration Form, they agree to accept all of these terms and conditions contained herein, and when the booking is accepted, Videre Travel agrees to carry out the obligations as defined therein.

 

UPDATING OF TERMS & CONDITIONS

Videre Travel reserves the right to update and/or alter these terms and conditions at any time, and it is the Client’s responsibility to be familiar with them. The latest terms and conditions may be found on Videre Travel’s website.

 

YOUR AGREEMENT WITH REGARD TO USE OF THIS WEBSITE
